The defense attorney’s request was granted by the presiding judge of the Gombe High Court Government Reserved Area, Daurabo Sikkam, in a case involving six sisters and the Kamai District Head, Zubairu Ahmadu, and three other people.
Aliona Toddo, Rony Toddo, Asabar Toddo, Saratu Toddo, Hassana Toddo, and Hussaina Toddo are the six sisters.
According to our correspondent, Ahmadu was the target of a lawsuit brought by a global non-governmental organization for allegedly depriving Toddo’s daughters of the farms that were supposed to be their late father’s inheritance.
The traditional figure was charged with plotting to deny the women the farms based on their gender along with Julius Lamido, Jude Maigari, and Dolton Toddo.
The plaintiffs’ suit seeks the court’s order confirming that they are the owners of farmland located at Ladongor, Lakwantangalan, and Lakaikai as well as a house built on the land at Kalmai, Billiri, Gombe State, said Barrister Ibrahim Ambore-Nuhu, counsel to the North-East regional office of GPAN, in an interview with journalists on Thursday.
A portion of the plaintiffs’ inherited farmland in Ladongor, Kalmai Billiri Gombe state, that was sold by the fourth defendant to the first, second, and third defendants without the plaintiffs’ consent was also demanded to be annulled by the court.
According to section 42 of the 1999 constitution and the validity test of customary law, the plaintiffs have a right to their late father’s (Amin Toddo’s) property.
“We need an order from this honorable court directing the distribution from their mother’s side (Kebba) to the late Amin Toddo’s heirs, i.e. the plaintiffs and the fourth defendant, of the farmland located and situated at Ladongor, Lakwantangalan, Lakaikai, the house built on the land, and any other properties left by their late father Amin Toddo at Kalmai, Billiri, Gombe State.
The first, second, and third defendants, their servants, or privies are prohibited from further trespassing on or interfering with the farmland located at Ladongor, Kalmai Billiri Gombe State, he said.
Additionally, the defendants’ attorney, Barrister Ishaku David, informed the court that his clients had requested a period of time to respond to the summons that had been served on them.
The court postponed the hearing until April 27, 2023.
